  1. Bootstrapping and Persuasive Argumentation
    Abstract

    AbstractThat bootstrapping and Moorean reasoning fail to instantiate persuasive argumentation is an often informally presented but not systematically developed view. In this paper, I will argue that this unpersuasiveness is not determined by principles of justification transmission but by two straightforward principles of rationality, understood as a concept of internal coherence. First, it is rational for S to believe the conclusion of an argument because of the argument, only if S believes sufficiently many premises of the argument. Second, if S doubts that a source O is reliable and believes that information i is delivered by O, then S rationally suspends judgment about the truth of i. This paper aims to accomplish two tasks. First, it provides a thorough analysis of why bootstrapping argumentation is not an instance of rational persuasion. Second, it contains a more general theory about preconditions and limits of persuasive argumentation.

  1. Argumentation and Identity: A Normative Evaluation of the Arguments of Delegates to the COP26 UN Climate Change Conference
    Abstract

    AbstractArguments may sometimes be advanced with a non-standard function. One such function, it is suggested, is the expression of identity, a practice which may play a significant role in political representation. This paper sets out to examine a number of short addresses given at the High-Level segment of the Cop26 conference, which are considered to contain instances of such argumentation. Their content is analysed and evaluated by means of the Comprehensive Assessment Procedure for Natural Argumentation (CAPNA), and an attempt is made to highlight the purposes of the delegates in addressing the conference. At a more fundamental level, the goal of this work is to assess the possibility of identifying arguments as being meant largely as statements of identity or representation, and the suitability of the CAPNA or other norm-based systems for evaluating such discourse. The speakers studied include representatives from OPEC, the Trade Unions, and the leaders of Vietnam and Liechtenstein. Ultimately, the study concludes that while further work is necessary both on understanding the relationship between argument and identity in the political arena, and on the application of argument norms to representational discourse, evaluations of this kind are meaningful and informative.

  3. It’s not (only) about Getting the Last Word: Rhetorical Norms of Public Argumentation and the Responsibility to Keep the Conversation Going
    Abstract

    AbstractThe core function of argumentation in a democratic setting must be to constitute a modality for citizens to engage differences of opinion constructively – for the present but also in future exchanges. To enable this function requires acceptance of the basic conditions of public debate: that consensus is often an illusory goal which should be replaced by better mastery of living with dissent and compromise. Furthermore, it calls for an understanding of the complexity of real-life public debate which is an intermixture of claims of fact, definition, value, and policy, each of which calls for an awareness of the greater ‘debate environment’ of which particular deliberative exchanges are part. We introduce a rhetorical meta-norm as an evaluation criterion for public debate. In continuation of previous scholarship concerned with how to create room for differences of opinion and how to foster a sustainable debate culture, we work from a civically oriented conception of rhetoric. This conception is less instrumental and more concerned with the role of communication in public life and the maintenance of the democratic state. A rhetorical meta-norm of public argumentation is useful when evaluating public argumentation – not as the only norm, but integrated with specific norms from rhetoric, pragma-dialectics, and formal logic. We contextualise our claims through an example of authentic contemporary public argumentation: a debate over a biogas generator in rural Denmark.

  4. Norms of Public Argumentation and the Ideals of Correctness and Participation
    Abstract

    AbstractArgumentation as the public exchange of reasons is widely thought to enhance deliberative interactions that generate and justify reasonable public policies. Adopting an argumentation-theoretic perspective, we survey the norms that should govern public argumentation and address some of the complexities that scholarly treatments have identified. Our focus is on norms associated with the ideals of correctness and participation as sources of a politically legitimate deliberative outcome. In principle, both ideals are mutually coherent. If the information needed for a correct deliberative outcome is distributed among agents, then maximising participation increases information diversity. But both ideals can also be in tension. If participants lack competence or are prone to biases, a correct deliberative outcome requires limiting participation. The central question for public argumentation, therefore, is how to strike a balance between both ideals. Rather than advocating a preferred normative framework, our main purpose is to illustrate the complexity of this theme.

  5. Epistemic Norms for Public Political Arguments
    Abstract

    AbstractThe aim of the article is to develop precise epistemic rules for good public political arguments, by which political measures in the broad sense are justified. By means of a theory of deliberative democracy, it is substantiated that the justification of a political measure consists in showing argumentatively that this measure most promotes the common good or is morally optimal. It is then discussed which argumentation-theoretical approaches are suitable for providing epistemically sound rules for arguments for such theses and for the associated premises, rules whose compliance implies the truth or acceptability of the thesis. Finally, on the basis of the most suitable approach, namely the epistemological one, such systems of rules for the required types of arguments are presented that fulfil the conditions mentioned.

  2. The Dialectical Principle of Charity: A Procedure for a Critical Discussion
    Abstract

    AbstractThis paper aims to discuss a well-known concept from argumentation theory, namely the principle of charity. It will show that this principle, especially in its contemporary version as formulated by Donald Davidson, meets with some serious problems. Since we need the principle of charity in any kind of critical discussion, we propose the way of modifying it according to the presupponendum—the rule written in the sixteenth century by Ignatius Loyola. While also corresponding with pragma-dialectical rules, it also provides additional content. This will be termed the dialectical principle of charity, and it offers a few steps to be performed during an argument in order to make sure that the participants understand each other well and are not deceived by any cognitive bias. The meaning of these results could be of great significance for argumentation theory, pragma-dialectics and the practice of public discourse as it enhances the principle of charity and makes it easier to apply in argumentation.

  3. High Costs and Low Benefits: Analysis and Evaluation of the “I’m Not Stupid” Argument
    Abstract

    AbstractThis article presents an analysis and evaluation of what I call the “I’m not stupid” argument. This argument has ancient roots, which lie in Aristotle’s famous description of the weak man’s and strong man’s arguments. An “I’m not stupid” argument is typically used in a context of accusation and defense, by a defendant who argues that they did not commit the act of which they have been accused. The analysis of this type of argument takes the shape of an argumentative pattern, which displays a full-fledged representation of its argumentation structure. It is based on a collection of ten contemporary instances of the “I’m not stupid” argument. Although ten instances constitute a small collection, the wide variation in the argumentative elements that they express explicitly or leave implicit made it possible to identify five new key premises in comparison with previous analyses of the weak man’s and strong man’s arguments (Walton, Tindale and Gordon 2014 in Argumentation 28:85–119, 2014; Walton 2019 in Argumentation 33:45–74, 2019). These new premises show that the crucial point of an evaluation of this argument is the arguer's supposedly rational character in making a gain-loss calculation. They also show that we need empirical data to strengthen our analyses of argument schemes and argumentation structures.

  2. The Making of Argumentation Theory: A Pragma-dialectical View
    Abstract

    AbstractIn ‘The making of argumentation theory’ van Eemeren and van Haaften describe the contributions made to the five components of a full-fledged research program of argumentation theory by four prominent approaches to the discipline: formal dialectics, rhetoric/pragmalinguistics, informal logic, and pragma-dialectics. Most of these approaches do not contribute to all components, but to some in particular. Starting from the pragma-dialectical view of the relationship between dialectical reasonableness and rhetorical effectiveness – the crucial issue in argumentation theory – van Eemeren and van Haaften explain the positions taken by representatives from the approaches discussed and indicate where they differ from the pragma-dialectical approach. It transpires that approaches focusing on dialectical reasonableness are, next to pragma-dialectics, formal dialectics and informal logic; approaches focusing on rhetorical effectiveness are, next to pragma-dialectics, rhetoric and pragmalinguistics, and the informal logician Tindale. When it comes to the relationship between dialectical reasonableness and rhetorical effectiveness, some interest in it is shown in rhetoric and pragmalinguistics, but only in pragma-dialectics and in Tindale’s work is it a real focus. The main difference between Tindale’s view and the pragma-dialectical view is that in pragma-dialectics the decisive role in deciding about reasonableness is assigned to a code of conduct for reasonable argumentative discourse and in Tindale’s approach this role is assigned to Tindale’s interpretation of the Perelmanian universal audience.

  3. Disentangling Critical Questions from Argument Schemes
    Abstract

    AbstractCritical questions have been understood in the framework of argument schemes from their conception. This understanding has influenced the process of evaluating arguments and the development of classifications. This paper argues that relating these two notions is detrimental to research on argument schemes and critical questions, and that it is possible to have critical questions without relying on argument schemes. Two objections are raised against the classical understanding of critical questions based on theoretical and analytical grounds. The theoretical objection presents the assumptions that are embedded in the idea of argument schemes delivering questions to evaluate arguments. The analytical objection, on the other hand, exposes the shortcomings of the theory when critical questions are used to evaluate real-life argumentation. After presenting these criticisms, a new theory of critical questions is sketched. This theory takes into account the dynamics of dialectical discussions to describe the function of critical questions and their implications for evaluating arguments.

  4. Assessing Classification Reliability of Conditionals in Discourse
    Abstract

    AbstractConditional constructions (if–then) enable us to express our thoughts about possible states of the world, and they form an important ingredient for our reasoning and argumentative capabilities. Different types and argumentative uses have been distinguished in the literature, but their applicability to actual language use is rarely evaluated. This paper focuses on the reliability of applying classifications of connections between antecedents and consequents of conditionals to discourse, and three issues are identified. First, different accounts produce incompatible results when applied to language data. Second, a discrepancy between theory and data was observed in previous studies, which sometimes discard existing classifications for being detached from actual language use. Finally, language users construct various cognitive relations between clauses of conditionals without being able to rely on overt linguistic features, which poses problems for the annotation of conditionals in argumentation and discourse. This paper addresses these issues by means of comparing theoretical types and actual uses of conditionals, by inspecting the dispersion of types in natural-language corpora, and by conducting an experiment in which the inter-rater reliability of classifications was assessed. The results show that the reliability of classifications of conditionals when applied to language data is low. With respect to the aforementioned issues, different classifications produced incompatible results, a discrepancy between theory and data was indeed observed, and low reliability scores indicated a largely interpretative nature of types of conditionals. Given these results, suggestions for the enhancement of reliability in corpus studies of conditionals and beyond are provided to enhance future classification design.

    Abstract

    AbstractThis paper analyses a hitherto unknown technique of using logic diagrams to create argument maps in eristic dialectics. The method was invented in the 1810s and -20s by Arthur Schopenhauer, who is considered the originator of modern eristic. This technique of Schopenhauer could be interesting for several branches of research in the field of argumentation: Firstly, for the field of argument mapping, since here a hitherto unknown diagrammatic technique is shown in order to visualise possible situations of arguments in a dialogical controversy. Secondly, the art of controversy or eristic, since the diagrams do not analyse the truth of judgements and the validity of inferences, but the persuasiveness of arguments in a dialogue.

  5. The Persistent Interlocutor
    Abstract

    AbstractA Persistent Interlocutor (PI) is someone who, in argumentative contexts, does not cease to question her opponent’s premises. The epistemic relevance of the PI has been debated throughout the history of philosophy. Pyrrhonians famously claim that our inability to dialectically vindicate our claims against a PI implies scepticism. Adam Leite disagrees (2005). Michael Resorla argues that the debate is based on a false premise (2009). In this paper, I argue that these views all fail to accurately account for the epistemic relevance of the PI. I then briefly present an account that aims to do better in this regard, based on the modal notion of safety. On the account proposed, the PI does not violate epistemic or dialectical norms. Rather, her behaviour tends to be epistemically perverse in the sense that it wastes cognitive resources. Perhaps surprisingly, this defect turns out not to be unique to the PI.

  6. Twitter Activists’ Argumentation Through Subdiscussions: Theory, Method and Illustration of the Controversy Surrounding Sustainable Fashion
    Abstract

    Abstract“Why are millions of dollars worth of orders being left unpaid?”. With tweets like this questioning brands’ policies, activists advocating for sustainable fashion re-discuss material starting points that are assumed by fashion brands, who argue that they are sustainable because they care about their workers’ conditions. This paper argues that activists use tweets to open subdiscussions on material starting points to engage citizens and consumers, re-discussing factual data that brands take for granted, such as the fact that they provide fair conditions for their garment workers. Activists justify their opening of subdiscussions, often through an argumentative pattern that includes an argument based on the locus from effects to cause. They argue that if there are negative effects, the brand cannot claim to care about the conditions of its workers. In discussing how subdiscussions are used by fashion activists, this paper also introduces a conceptualization of Twitter argumentation as a discussion that is not isolated, but is part of a polylogical argumentation that takes place in different venues. For this reason, the argumentation used in tweets is reconstructed as a response to a fashion brand’s communication campaigns around sustainability, which extend beyond the confines of Twitter. As an empirical illustration, this paper is based on the campaign targeting fashion retailer Primark; the dataset includes the brand’s website as well as activists’ tweets.

  1. Representing the Structure of a Debate
    Abstract

    AbstractIn this article I aim to use the 1948 Russell-Copleston debate to highlight some recent problems I have experienced teaching argument analysis in my philosophy courses. First, I will use argument diagramming to represent the arguments in the debate while reflecting on the use of this approach use to teach argument analysis skills. Then, I will discuss the tools and methods scholars have proposed to represent debates, rather than just individual arguments. Finally, I will argue that there is not, but needs to be, a good way to represent argumentative debates in a way that neither obscures the essential details of the exchange nor becomes too unwieldy to extract a sense of the overall debate.

  4. Two Types of Refutation in Philosophical Argumentation
    Abstract

    AbstractIn this paper, I highlight the significance of practices of refutation in philosophical inquiry, that is, practices of showing that a claim, person or theory is wrong. I present and contrast two prominent approaches to philosophical refutation: refutation in ancient Greek dialectic (elenchus), in its Socratic variant as described in Plato’s dialogues, and as described in Aristotle’s logical texts; and the practice of providing counterexamples to putative definitions familiar from twentieth century analytic philosophy, focusing on the so-called Gettier problem. Moreover, I discuss Lakatos’ method of proofs and refutations, as it offers insightful observations on the dynamics between arguments, refutations, and counterexamples. Overall, I argue that dialectic, in particular in its Socratic variant, is especially suitable for the philosophical purpose of questioning the obvious, as it invites reflection on one’s own doxastic commitments and on the tensions and inconsistencies within one’s set of beliefs. By contrast, the counterexample-based approach to philosophical refutation can give rise to philosophical theorizing that is overly focused on hairsplitting disputes, thus becoming alienated from the relevant human experiences. Insofar as philosophical inquiry treads the fine line between questioning the obvious while still seeking to say something significant about human experiences, perhaps a certain amount of what Lakatos describes as ‘monster-barring’—a rejection of overly fanciful, artificial putative counterexamples—has its place in philosophical argumentation.

  5. Argumentation in Philosophical Controversies
    Abstract

    AbstractAnyone interested in philosophical argumentation should be prepared to study philosophical debates and controversies because it is an intensely dialogical, and even contentious, genre of argumentation. There is hardly any other way to do them justice. This is the reason why the present special issue addresses philosophical argumentation within philosophical debates. Of the six articles in this special issue, one deals with a technical aspect, the diagramming of arguments, another contrasts two moments in philosophical argumentation, Antiquity and the twentieth century, focusing on the use of refutation, and the remaining four analyze particular philosophical controversies. The controversies analyzed differ significantly in their characteristics (time, extension, media, audience,…). Hopefully, this varied sample will illuminate some salient aspects of philosophical argumentation, its representation and variations throughout history. We are fully aware that, given the scarcity of previous studies of philosophical debates from the perspective of argumentation theory, the following specimens of analysis must have several shortcomings. But it is a well-known adage that the hardest part is the beginning. That is what we tried to achieve here, no more, but no less either.

  6. An Unconscious Universal in the Mind is Like an Immaterial Dinner in the Stomach. A Debate on Logical Generalism (1914–1919)

    AbstractThe debate on the a fortiori and the universal that took place between April 1914 and April 1919 in the journal Mind has a double interest for argumentation theorists. First, the discussion is an example of a philosophical polylogue that exhibits the characteristics of a quasi-engaged dialogue (Blair Blair, J. A. (2012 [1998]). “The Limits of the Dialogue Model of Argument”. Argumentation 12, pp. 325–339. Reprinted in J.A. Blair, Groundwork in the Theory of Argumentation, pp. 231–244. Dordrecht: Springer, 2012.), confirming Blair’s hypothesis that journal papers and scholarly monographs can be analyzed as turns in non-engaged or quasi-engaged dialogues. It could be said that philosophical argumentation is dialectical but not dialogical. Second, the debate is a discussion in argumentation theory. Generalism in the theory of argument claims that the very possibility of arguing depends on a suitable supply of general rules that specify what kinds of conclusions can be drawn from what kinds of data, while particularism denies this. Although the terminology may be alien, I will also show that the debate on the a fortiori and the universal was a debate on generalism and particularism.

  3. Argumentation in Suboptimal Settings
    Abstract

    AbstractWhen parties attempt to persuade their opponents of the tenability of a certain standpoint using reasons, they will often find that the circumstances of the dialogue hinder their chances of resolution. Power imbalances, cognitive biases, lack of time or hidden interests are some of the circumstances they need to face. I will label these circumstances as suboptimal settings for argumentation. According to the pragma-dialectical tradition, higher-order conditions for critical discussion are unfulfilled in these cases (van Eemeren, Grootendorst, Jacobs, & Jackson, 1993). The main question of this paper is the following: what is the normative standard that parties in a discussion need to follow to arrive at a resolution within such circumstances? I will defend a middle-ground solution between two extreme ones.The first extreme position, the anything-goes policy, claims that, given that the conditions for a reasonable exchange of reasons are not satisfied, the dialogue stands outside the domain of reason, so anything goes for the parties. The second extreme position, the business as usual policy, claims that, since critical discussion is a normative model, the same rules should apply in suboptimal settings. Finally, the supernormal policy that I defend claims that we need a more general and comprehensive norm that I refer to as a supernorm to evaluate these cases.The supernormal policy divides argumentation into two stages: preparation and resolution. In the preparation stage, the parties attempt to restore or compensate for the suboptimality of the setting, while in the resolution stage, they attempt to resolve their disagreement. I contend that the moves of the preparation stage should be evaluated by using the supernorm instead of by the rules for critical discussion (van Eemeren and Grootendorst 2004). At this point, the paper considers theoretical insights from Gilbert (1995, 1997, 2002) and Jacobs (2000, 2006) to understand what this entails.

  1. When Evaluative Adjectives Prevent Contradiction in a Debate
    Abstract

    AbstractThis paper argues that some words are so highly charged with meaning by a community that they may prevent a discussion during which each participant is on an equal footing. These words are indeed either unanimously accepted or rejected. The presence of these adjectival groups pushes the antagonist to find rhetorical strategies to circumvent them. The main idea we want to develop is that some propositions are not easily debatable in context because of some specific value-bearing words (VBWs), and one of the goals of this paper is to build a methodological tool for finding and classifying these VBWs (with a focus on evaluative adjectives). Our study echoes the importance of “cultural keywords” (as reported by Wierzbicka, Understanding cultures through their key words: English, Russian, Polish, German, and Japanese, 1997) in argument (as reported by Rigotti & Rocci, Argumentation in practice, 2005), but is rather based on a German approach developed by (as reported by Dieckmann, Sprache in der Politik: Einführung in die Pragmatik und Semantik der politischen, 1975), (as reported by Strauss and Zifonun, Der politische Wortschatz, 1986), and (as reported by Girnth, Sprache und Sprachverwendung in der Politik: Eine Einführung in die linguistische Analyse öffentlich-politischer Kommunikation, 2015) about “Miranda” and “Anti-Miranda” words that is expanded and refined here. In particular, our study tries to understand why some statements, fueled by appreciative (Tseronis, 2014) or evaluative adjectives, have such rhetorical effects on a pragmatic level in the particular context of a vote on the Swiss popular initiative called “for more affordable housing”. This context is fruitful since two parties offer reasons for two opposing policy claims: namely, to accept or to reject an initiative. When one party uses arguments containing such universally unassailable adjectival groups to defend a “yes” vote (in our example, pleading for more affordable housing rents), the opposing party cannot use a symmetrical antonym while pleading for the “no” vote. The methodological tool that is proposed here could shed light on the use of certain rhetorical and referential strategies in conflicting policy proposition contexts.

  4. Questions, Presuppositions and Fallacies
    Abstract

    AbstractIn this paper I focus on the fallacy known as Complex Question or Many Questions. After a brief introduction, in Sect. 2 I highlight its pragmatic dimension, and in Sect. 3 its dialectical dimension. In Sect. 4 I present two accounts of this fallacy developed in argumentation theory, Douglas Walton’s and the Pragma-Dialectics’, which have resources to capture both its pragmatic and its dialectical nature. However, these accounts are unsatisfactory for various reasons. In Sect. 5 I focus on the pragmatic dimension of the fallacy and I suggest amendments to the accounts mentioned drawing on the study of the phenomenon of presupposition in theoretical pragmatics. I argue that the central notion in the definition of the fallacy is that of an informative presupposition. In Sect. 6 I focus on the dialectical dimension of the fallacy. This dimension needs to be explicitly acknowledged in the definition of the fallacy in order to distinguish it from a different, non-dialectical, fallacious argumentative move involving presuppositions.

    AbstractIn their bookCommitment in Dialogue, Walton and Krabbe claim that formal dialogue systems for conversational argumentation are “not very realistic and not easy to apply”. This difficulty may make argumentation theory less well adapted to be employed to describe or analyse actual argumentation practice. On the other hand, the empirical study of real-life arguments may miss or ignore insights of more than the two millennia of the development of philosophy of language, rhetoric, and argumentation theory. In this paper, we propose a novel methodology for adapting such theories to serve as applicable tools in the study of argumentation phenomena. Our approach is boththeoretically-informedandempirically-groundedin large-scale corpus analysis. The area of interest are appeals to ethos, the character of the speaker, building upon Aristotle’s rhetoric. Ethotic techniques are used to influence the hearers through the communication, where speakers might establish, but also emphasise, weaken or undermine their own or others’ credibility and trustworthiness. Specifically, we apply our method to Aristotelian theory of ethos elements which identifiespractical wisdom,moral virtueandgoodwillas components of speakers’ character, which can be supported or attacked. The challenges we identified in this case and the solutions we proposed allow us to formulate general guidelines of how to exploit rich theoretical frameworks to the analysis of the practice of language use.

  2. Socratic Irony and Argumentation
    Abstract

    AbstractSocratic irony can be understood independently of the immortal heroics of Plato’s Socrates. We need a systematic account and criticism of it both as a debate-winning strategy of argumentation and teaching method. The Speaker introduces an issue pretending to be at a lower intellectual level than her co-debaters, or Participants. An Audience looks over and evaluates the results. How is it possible that the Speaker like Socrates is, consistently, in the winning position? The situation is ironic because the Participants fight from a losing position but realize it too late. Socratic irony compares with divine irony: divine irony is a subtype of Socratic irony since you lose when you challenge gods. Socratic irony is also, prima facie, a subtype of dramatic irony when the Audience knows more than the Participants on the stage.We must distinguish between the ideal and realistic elements of Socratic Irony. The very idea of Socratic irony looks idealized, or it is an ideal case, which explains the Speaker’s consistently winning position. In real life, the debate must be rigged, or the Dutch Book argument applies to the Participants, if the Speaker is so successful.

  3. Evaluating Reasoning in Natural Arguments: A Procedural Approach
    Abstract

    AbstractIn this paper, we formulate a procedure for assessing reasoning as it is expressed in natural arguments. The procedure is a specification of one of the three aspects of argumentation assessment distinguished in the Comprehensive Assessment Procedure for Natural Argumentation (CAPNA) (Hinton, 2021) that makes use of the argument categorisation framework of the Periodic Table of Arguments (PTA) (Wagemans, 2016, 2019, 2020c). The theoretical framework and practical application of both the CAPNA and the PTA are described, as well as the evaluation procedure that combines the two. The procedure is illustrated through an evaluation of the reasoning of two example arguments from a recently published text.

  1. Associating Ethos with Objects: Reasoning from Character of Public Figures to Actions in the World
    Abstract

    AbstractEthotic arguments, such as arguments from expert opinion and ad hominem arguments, play an important role in communication practice. In this paper, we argue that there is another type of reasoning from ethos, in which people argue about actions in the world. These subspecies of ethotic arguments are very common in public debates: societies are involved in heated disputes about what should be done with monuments of historical figures such as Stalin or Colston: Should we demolish the building they funded? Should we revere their statues? Should the street named after them be renamed?; and the general public vividly argue about what should be done with the legacy of producers, directors and actors in debates of the #MeToo movement: Should their new movies be distributed? Should their scenes be deleted from motion pictures? Should their stars from the Hollywood Walk of Fame be removed? Many arguments in these debates boil down to the character of the public figures: He was a slave trader!—But he is a part of our history; He harassed a young girl!—But he is an important actor. The reasoning step here is legitimised by the association between a person and an extra-linguistic object: the association between a historical figure and their statue or between an actor and their movie. The nature of this association is explained in the paper using Peirce’s theory of signs. We propose to extend an existing approach to patterns of reasoning from ethos that will help us to shed new light on ethotic argumentation and open an avenue for a systematic account of these unexplored argument forms.

    Abstract

    AbstractCurrent formal dialectical models postulate normative rules that enable discussants to conduct dialogical interactions without committing fallacies. Though the rules for conducting a dialogue are supposed to apply to interactions between actual arguers, they are without exception theoretically motivated. This creates a gap between model and reality, because dialogue participants typically leave important content-related elements implicit. Therefore, analysts cannot readily relate normative rules to actual debates in ways that will be empirically confirmable. This paper details a new, data-driven method for describing discussants’ actual reply structures, wherein corpus studies serve to acknowledge the complexity of natural argumentation (itself understood as a function of context). Rather than refer exclusively to propositional content as an indicator of arguing pro/contra a given claim, the proposed approach to dialogue structure tracks the sequence of dialogical moves itself. This arguably improves the applicability of theoretical dialectical models to empirical data, and thus advances the study of dialogue systems.

  1. Defeasibility, Law, and Argumentation: A Critical View from an Interpretative Standpoint
    Abstract

    AbstractThe phenomenon of defeasibility has long been a central theme in legal literature. This essay aims to shed new light on that phenomenon by clarifying some fundamental conceptual issues. First, the most widespread definition of legal defeasibility is examined and criticized. The essay shows that such a definition is poorly constructed, inaccurate and generates many problems. Indeed, the definition hides the close relationship between legal defeasibility and legal interpretation. Second, this essay argues that no new definition is needed. I will show that from an interpretative standpoint, there is nothing special about legal defeasibility. Contrary to what some authors maintain, no unique or privileged source of legal defeasibility exists, nor are there privileged arguments to justify it. Specifically, legal defeasibility refers to interpretative outcomes deriving from interpretative arguments that, on the one hand, are very different from one another, and, on the other, are often employed to justify different interpretative outcomes. In the legal field, the problems related to defeasibility have little in common with the problems that this label covers in other areas—such as logic or epistemology—and they are nothing but the well-known problems related to legal interpretation. In conclusion, this paper argues that as far as legal argumentation is concerned, the notion of legal defeasibility lacks explanatory power, and it should be abandoned.

    AbstractThe aim of this article is to show how modifications of meaning can influence argumentation. I present the basic concept of so-called ‘semantic argumentation,’ its definition, and its different variants. I analyse the various kinds of argument in which meanings of terms are modified in support of a persuasive goal. The analysis of different semantic arguments reveals certain structures and patterns that are needed to construct a typology of such arguments. I thus outline a basic concept of argumentation based on modifications of meaning, before presenting various examples of such arguments together with an analysis of their structures, and then, finally, constructing a typology for them.

  4. The Linguistic Formulation of Fallacies Matters: The Case of Causal Connectives
    Abstract

    AbstractWhile the role of discourse connectives has long been acknowledged in argumentative frameworks, these approaches often take a coarse-grained approach to connectives, treating them as a unified group having similar effects on argumentation. Based on an empirical study of the straw man fallacy, we argue that a more fine-grained approach is needed to explain the role of each connective and illustrate their specificities. We first present an original corpus study detailing the main features of four causal connectives in French that speakers routinely use to attribute meaning to another speaker (puisque, étant donné que, vu que and comme), which is a key element of straw man fallacies. We then assess the influence of each of these connectives in a series of controlled experiments. Our results indicate each connective has different effects for the persuasiveness of straw man fallacies, and that these effects can be explained by differences in their semantic profile, as evidenced in our corpus study. Taken together, our results demonstrate that connectives are important for argumentation but should be analyzed individually, and that the study of fallacies should include a fine-grained analysis of the linguistic elements typically used in their formulation.

  5. Corpus Linguistics Methods in the Study of (Meta)Argumentation
    Abstract

    AbstractAs more and more sophisticated software is created to allow the mining of arguments from natural language texts, this paper sets out to examine the suitability of the well-established and readily available methods of corpus linguistics to the study of argumentation. After brief introductions to corpus linguistics and the concept of meta-argument, I describe three pilot-studies into the use of the terms Straw man, Ad hominem, and Slippery slope, made using the open access News on the Web corpus. The presence of each of these phrases on internet news sites was investigated and assessed for correspondence to the norms of use by argumentation theorists. All three pilot-studies revealed interesting facts about the usage of the terms by non-specialists, and led to numerous examples of the types of arguments mentioned. This suggests such corpora may be of use in two different ways: firstly, the wider project of improving public debate and educating the populace in the skills of critical thinking can only be helped by a better understanding of the current state of knowledge of the technical terms and concepts of argumentation. Secondly, theorists could obtain a more accurate picture of how arguments are used, by whom, and to what reception, allowing claims on such matters to be evidence, rather than intuition, based.

  2. On the Differences Between Practical and Cognitive Presumptions
    Abstract

    AbstractThe study of presumptions has intensified in argumentation theory over the last years. Although scholars put forward different accounts, they mostly agree that presumptions can be studied in deliberative and epistemic contexts, have distinct contextual functions (guiding decisions vs. acquiring information), and promote different kinds of goals (non-epistemic vs. epistemic). Accordingly, there are “practical” and “cognitive” presumptions. In this paper, I show that the differences between practical and cognitive presumptions go far beyond contextual considerations. The central aim is to explore Nicholas Rescher’s contention that both types of presumptions have a closely analogous pragmatic function, i.e., that practical and cognitive presumptions are made to avoid greater harm in circumstances of epistemic uncertainty. By comparing schemes of practical and cognitive reasoning, I show that Rescher’s contention requires qualifications. Moreover, not only do practical and cognitive presumptions have distinct pragmatic functions, but they also perform different dialogical functions (enabling progress vs. preventing regress) and, in some circumstances, cannot be defeated by the same kinds of evidence. Hence, I conclude that the two classes of presumptions merit distinct treatment in argumentation theory.
